Motorway Breakdown Rules UK – What The Highway Code Actually Says (And What You MUST Do)

Rule 1 – Where You Can (And Can't) Stop on a Motorway

Hard shoulder: ✅ Legal (emergency only). You may stop on the hard shoulder in a genuine emergency – breakdown, accident, or medical emergency.

Live lane: ❌ Illegal and extremely dangerous. Stopping in a live lane is an offence. Penalty: fine up to £100 and 3 penalty points.

Smart motorway without ERA: ❌ Not permitted. If you break down on a smart motorway section without a hard shoulder, you must reach an emergency refuge area. If you cannot, call 999 immediately – Highways England may close a lane.

Rule 2 – Hard Shoulder Rules (Highway Code Rule 278)

• Pull over as far left as possible
• Left exit only – never exit towards live traffic
• Hazard lights on immediately
• Exit the vehicle from the passenger side
• Get behind the safety barrier if possible
• Do NOT stand between your car and the barrier
• Do NOT attempt repairs on the hard shoulder

Rule 3 – Smart Motorway Rules (No Hard Shoulder)

• If you can reach an emergency refuge area (ERA): Pull in. Orange tarmac. Blue sign with SOS phone symbol. Hazard lights on. Stay in your car. Use SOS phone or call 999.
• If you cannot reach an ERA: Do NOT stop in a live lane unless absolutely necessary. Hazard lights on. Stay in your car. Call 999 immediately.
• Never get out of the vehicle on a smart motorway without a hard shoulder.

Rule 4 – Warning Triangles – Legal or Not?

Not required by UK law. Unlike France, Spain, Germany, and Italy, warning triangles are not legally required in the UK for passenger cars.

You may use one on a traditional hard shoulder (place 45 metres behind your vehicle).

Never use a warning triangle on a smart motorway without a hard shoulder – walking in a live lane is extremely dangerous.

Rule 5 – When MUST You Call 999?

You MUST call 999 if:

• You are in a live lane and cannot move
• You are blocking traffic
• You are on a smart motorway without a hard shoulder and cannot reach an ERA
• There is an injury or medical emergency
• There is a fire

If you are safe on a hard shoulder or in an emergency refuge area, you can call your breakdown provider.

Rule 6 – What NEVER To Do on a Motorway

• ❌ Stand between your car and the barrier – if your car is hit from behind, you will be crushed
• ❌ Walk on the motorway – drivers do not expect pedestrians
• ❌ Attempt to repair your vehicle – call a professional
• ❌ Cross the carriageway – 70mph traffic both ways
• ❌ Accept help from strangers who pull over – well-meaning but dangerous
• ❌ Use a warning triangle on a smart motorway
